CONTEST OVERVIEW: The “Win a Spa Full Day Retreat” Contest (the “Contest”) is sponsored by Buffalo MRI, Snyder Place Plaza, 4925 Main Street, Amherst, New York 14226 (“Sponsor”). The Contest is governed by these official rules. Through your participation in the Contest as a participant, you agree to abide by and be subject to these official rules and understand that the Sponsor-determined results of the Contest shall be final in all respects.
ELIGIBILITY: The Contest is open to natural persons that are 18 years of age or older, legal residents of the 50 United States of America and the District of Columbia, have internet access, and have a valid e-mail account established before the commencement of the Contest Period (as defined below), except for those residents of any state or locality where a promotion such as the Contest is prohibited or restricted by federal, state or local laws or regulations. Directors, officers, employees and representatives (and their immediate family members (defined as parents, spouses, children, siblings and grandparents) and individuals residing in the same household of such family members) of: (i) the Sponsor; (ii) Clevermethod, Inc. (“Agent”); and (iii) any person, entity or organization that is a parent, subsidiary or affiliate of any entity listed in clauses (i) – (ii), shall be ineligible to participate in or win the Contest. Or any employee that works a Buffalo MRI. Sponsor reserves the right to verify the eligibility of each participant in the Contest.
HOW TO ENTER THE CONTEST: Beginning 8:00 am EST on April 14th 2010 through 10:00 p.m. EST on May 1st, 2010 (the “Contest Period”), log on to BuffaloMRI.com (the “Contest Website”). Click on the Contest link and follow the on-screen instructions to enter and participate in the Contest online. Participants must submit a completed Entry via the Contest Website that contains all requested information in order to have an Entry accepted by Sponsor. Participants may submit as many Entries as they like. By submitting an Entry, each participant in the Contest represents and warrants that he or she is eligible to participate in the Contest and has the authority to grant to Sponsor the rights provided in these official rules. Only Entries transmitted via the Contest Website during the Contest Period will be accepted. Sponsor reserves the right to determine what amounts to a received and completed Entry.
WINNING THE CONTEST: Each winner of the Contest (“Contest Winner”) will be selected from all eligible Entries received during the Contest Period in a drawing conducted by and in the sole discretion of representatives of Sponsor. There shall be a total of “1” Contest Winner selected by Sponsor. Each Contest Winner will be selected on or about May 1st, 2010 and will be notified within fourteen (14) days after the drawing by telephone, email or mail. In the event Sponsor cannot reach Contest Winner within fourteen (14) days after it attempts to notify such winner, Contest Winner shall forfeit its Contest Prize (as defined below) and Sponsor will then select a new Contest Winner. If any individual Contest Winner is ineligible to receive a Contest Prize or declines to accept a Contest Prize, Sponsor shall select a new Contest Winner. Odds of winning depend on the number of Entries received, but for purposes of these official rules, such odds are not expected to exceed 1,000:1 for each Contest Prize.
CONTEST PRIZES: Each Contest Winner will win A Full-Day Spa Retreat at Excuria Salon (“Contest Prize”). In no event shall the aggregate value of all Contest Prizes awarded under the Contest exceed $400.00. No Contest Prize is redeemable for cash value. Each Contest Prize is non-transferable. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY CONTEST PRIZE ARE SOLELY THE RESPONSIBILITY OF CONTEST WINNER AND WILL BE BASED ON THE ACTUAL RETAIL VALUE OF THE CONTEST PRIZE AWARDED. ANY PARTICIPANT SUBMITTING AN ENTRY MUST BE AWARE THAT SPONSOR MAY FILE TAX FORMS TO SATISFY ANY REPORTING OBLIGATION IT MAY HAVE WITH RESPECT TO THE AWARDING ANY CONTEST PRIZE TO A CONTEST WINNER AND CONTEST WINNER AGREES TO PROVIDE SPONSOR WITH ANY REQUIRED INFORMATION ACCORDINGLY.
GENERAL: All federal, state and local laws apply. Void where prohibited by law or regulation. By participating, any participant of the Contest releases Sponsor, and its respective officers, employees, agents, parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, the “Sponsor Affiliates”) from any and all liability, including without limitation, property damage, personal injury and/or death, resulting from such participant’s participation in the Contest or acceptance, use or misuse of any Contest Prize. Any participant further agrees that the Sponsor Affiliates are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Contest and the awarding of the Contest Prizes. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, each participant agrees that, by entering the Contest (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees or court costs; and (iii) under no circumstances will any participant be permitted to obtain any award for, and by entering and participating in the Contest, each participant irrevocably waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, other than damages for actual out-of-pocket expenses. Failure to comply with these official rules will result in disqualification from the Contest. All federal, state and local taxes related to the award of the Contest Prizes are the sole responsibility of each Contest Winner. No prize substitutions or election of cash equivalents are permitted. Sponsor reserves the right to substitute prizes of equal or greater value in the Sponsor’s sole discretion. Sponsor is not responsible for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission or failure resulting in the loss of any Entry and for information on account of technical problems or traffic congestion on the internet or at any web site or any combination thereof or any injury or damage to participant’s or any other person’s computer related to or resulting from participating in the Contest. In the event the integrity of the Contest becomes compromised in any manner as determined in Sponsor’s sole discretion, Sponsor reserves the right to cancel or modify the Contest before, during or after the Contest Period and to select a Contest Winner from those eligible Entries, if any, received up to the date of such cancellation or modification. Sponsor may engage certain third parties to perform services in connection with the administration of the Contest and information provided by participants may be collected and used by those third parties for purposes of administering the Contest and the fulfillment and verification of the Contest Prizes.
Contest Winners may be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within fourteen (14) days of request by Sponsor or the Contest Prize will be forfeited. Sponsor provides no warranty, implied or otherwise, as to the workmanship and materials used in relation to the Contest Prize.
LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT HAVING SUBMITTED AN ENTRY, TO DELIBERATELY INTERFERE WITH THE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

Winning entries will be available on the Contest Website for a period of at least one year following the end of the Contest Period.
PRIVACY: By entering the Contest, each participant submitting an Entry consents to the use of his or her name, city, state, and if applicable, likeness, without compensation, in any future publicity, carried out in any media by Sponsor or the Sponsor Affiliates in connection with the Contest, where permitted by law. Sponsor and the Sponsor Affiliates will not share any personal information received with any unrelated third party.
